Based on research conducted in preparation of a Greater China Legal History Seminar in 2018, Prof. Steven GALLAGHER, Dr. LIN Siyin (CUHK LAW LLM and PhD graduate) and Prof. Lutz-Christian WOLFF have completed a comprehensive comparative study on the development of the law of unjust enrichment in Germany, England and China. The findings have now been published under the title “The History of a Mystery: The Evolution of the Law of Unjust Enrichment in Germany, England and China” in the Spring 2020 volume of the International Comparative, Policy & Ethics Law Review (pp. 337-381). The study concludes that the single principle approach underscoring the unjust enrichment idea is not viable and should therefore be reconsidered.
