CUHK LAW hosted the Property Law Webinar ‘Toms v Ruberry: when can a CPO s. 58 notice be served?’ & ‘Gift, Sale, or Presumption of Resulting Trust?’ on 23 September 2020, the first in this series in academic year 2020/21. It was delivered by Professor Steven Gallagher and Professor Michael Lower, Professional Consultants from CUHK LAW. This CPD webinar attracted more than 190 participants, it introduced and evaluated the decision of the English Court of Appeal in Toms v Ruberry (the interaction of notices served pursuant to a requirement of the forfeiture clause in a lease and under CPO s.58) and of the Singaporean Court of Appeal in Ng Kong Yeam v. Kay Swee Pin  (rebutting the presumption of resulting trust). The webinar closed with a review of three recent cases illustrating the difficulties that the courts face in discerning intention in arrangements in the family setting.
