Property Law Seminar Series – ‘Equity and the Enforcement of Informal Land Contracts: Part II’ by Prof. Steven Gallagher, Prof. Alice Lee & Prof. Michael Lower (Online)

In a previous seminar we saw that part performance might be invoked where there is a valid oral contract but no writing to satisfy section 3(1) of the Conveyancing and Property Ordinance. In this seminar we examine the potential to argue that a claim in proprietary estoppel or a common intention constructive trust arises in these circumstances. Hong Kong, then, has three equitable doctrines at its disposal where there is an informal land contract. We will ask whether this is satisfactory. We note both the substantial overlaps between the doctrines and the differences between them.
