Ms Qian Yin is a PhD candidate at CUHK LAW. She has been a visiting researcher at the Max Planck Institute for Innovation and Competition and at Ludwig Maximilian University of Munich, and has published in leading journals including International Data Privacy Law, ICSID Review, and the Journal of World Trade.
Test Data Exclusivity and Trade Secrets for Pharmaceuticals in the US Domestic Legal Frameworks and FTA, co-supervised by Professors Jyh-An LEE and Shixue HU.

With my thesis, this thesis examines the complex relationship between pharmaceutical test data exclusivity provisions in US Free Trade Agreements (FTAs) and their interaction with US domestic regulatory frameworks and intellectual property regimes, particularly trade secrets. The research aims to analyse how US domestic legislation and judicial practices shape and influence pharmaceutical test data protection provisions in US FTAs, and radiates outward to trading partners through FTAs. It investigates the mechanisms through which US domestic standards are exported to FTA parties, including Special 301 Reports and FTA implementation negotiations, effectively globalising US regulatory approaches.
