Ms. Qian Yin is a PhD candidate at CUHK LAW. Her research interests lie in intellectual property law, international economic law, and data governance, with particular interest in World Trade Organization (WTO) law, free trade agreements, and the intersection between international trade and intellectual property law.
Test Data Exclusivity for Pharmaceuticals in US Free Trade Agreements, co-supervised by Professors Jyh-An LEE and Shixue HU.
With my thesis, I hope to answer how free trade agreements incorporate data exclusivity for pharmaceuticals to improve pharmaceutical-related intellectual property protection standards under the TRIPS Agreements. By exploring selective countries’ approaches to implementing the data exclusivity policy, the thesis proposes mitigating the data exclusivity under FTAs in response to the extended identification of public health-related rights.
