Prof. Eliza MIK has published an editorial titled “Smart Contracts and the Myth of Transparency” in the Journal of Consumer and Market Law. The editorial addresses the controversial phenomenon of smart contracts, distributed computer programs operating on blockchains that are often analysed within the framework of contract law. Given the numerous regulatory initiatives in this area, Prof. Mik provides a detailed explanation of the benefits and risks deriving from the ability to access and view the code of smart contracts, commonly referred to as “transparency.”  The editorial is available here.
