Competition law is under stress. Indeed, the economic framework that underlies competition law and is inherited from the neoclassical price theory is not well adapted to deal with issues in the digital sector because competition between platforms is very different from competition between pipeline firms and because the static framework of microeconomic theory is not fit to deal with dynamic competition through innovation. There is an urgent need to adapt our economic reasoning.
Frederic Jenny is Emeritus Professor of Economics at ESSEC Business School in France and Chairman of the OECD Global Forum on Competition. He was Chairman of the OECD Competition Committee (1994-2024), Judge of the French Supreme Court (Cour de Cassation) (2004-2012), Non Executive Director of the Office of Fair Trading in the United Kingdom (2007-2014) and Vice President of the French Competition Authority (1993-2004).
