CUHK LAW Alumni Online Seminar – ‘What you need to know about the liquidation regimes of Hong Kong, BVI and the Cayman Islands’

The presentation will focus on the liquidation regimes of Hong Kong, the BVI, and the Cayman Islands. We will cover essential issues of winding up, such as creditor-initiated winding up via statutory demands, standing questions – including recent debates on whether a “contingent creditor” can petition for winding up in all three jurisdictions – and how shareholder status affects the liquidation waterfall. Furthermore, we will examine the doctrine of just and equitable winding up, the differences between voluntary liquidation and strike-off, and the importance of supervision orders.

About the Speakers:

Ms. Catherine Wong, Associate, Conyers

Catherine is a trilingual disputes and restructuring lawyer qualified to practice in England & Wales, British Virgin Islands, Bermuda and Hong Kong. She also represents clients in Cayman Islands matters. Her practice covers all types of contentious cases, and focuses on offshore shareholders’ disputes, winding up and liquidation proceedings, insolvency and restructuring matters, private wealth and trust disputes, fair value appraisal proceedings, worldwide injunctions, and foreign judgment and arbitral award recognition and enforcement.

Catherine is featured on the ALB “Rising Stars” 2023 list as one of Hong Kong’s top 30 next generation lawyers who have demonstrated great potential in the industry, while earning wide acclaim from clients and peers. Additionally, she has been acknowledged by Legal 500 Asia-Pacific as a “key lawyer” for 2024 and mentioned in the editorial commentary for 2025, both in the “Recommended Lawyers” category.

Catherine is an active member of the Law Society of Hong Kong’s Insolvency Law Committee, Pro Bono Committee and Pro Bono and Community Work Recognition Committee. She is also an appointed member of the HKSAR Government’s Solicitors Disciplinary Tribunal Panel. In the past, she served as committee member in Law Society of Hong Kong’s Young Solicitors’ Group and the Law Week Organising Committee.

Catherine holds memberships in several professional organisations, including the International Association of Restructuring, Insolvency & Bankruptcy Professionals (INSOL), the Society of Trust and Estate Practitioners (STEP), the International Women’s Insolvency & Restructuring Confederation (IWIRC), the Company and Insolvency Law Society (COINS), the Chartered Institute of Arbitrators (MCIArb), the Hong Kong Institute of Arbitrators (HKIArb), the Hong Kong Mediation and Arbitration Centre (HKMAAC), the Hong Kong Mediation Centre (HKMC), the International Council for Commercial Arbitration (Young ICCA) and HK45, the Hong Kong International Arbitration Centre (HK45).

Catherine regularly publish articles in international law journals, and frequently delivers presentations on contemporary topics.

Ms. Pinky Chan, Senior Associate, Howse Williams

Pinky is a Senior Associate in Howse Williams’ Regulatory practice, specialising in contentious regulatory work, international arbitration and commercial litigation.

She has experience in dealing with inquiries and investigations by regulatory bodies such as the Securities and Futures Commission of Hong Kong and the Hong Kong Exchanges and Clearing Limited. She has acted for financial institutions, corporations and high-net-worth individuals in various domestic and cross-border commercial litigations and arbitrations. She has also advised clients in cases involving cross-border commercial disputes, fraud and asset recovery and restructuring and insolvency. She also has experience and interest in cryptocurrency-related litigation.

She has attained Fellowship with the Chartered Institute of Arbitrators and is an Associate of CPA Australia.
