CUHK LAW graduate Samuel Yee Ching LEUNG has published articles in Law Quarterly Review and Trust Law International

CUHK LAW JD and PCLL graduate Samuel Yee Ching LEUNG has published an article titled “Apparent Authority, Quincecare Duty and Termination of Banking Relationship” in Law Quarterly Review (Sweet & Maxwell). The article comments on the Hong Kong Court of Final Appeal decision PT Asuransi Tugu Pratama Indonesia TBK v Citibank NA (2023) 26 HKCFAR 1 on the issues of apparent authority and Quincecare duty in the context of banker-customer relationship and fraud.

Samuel’s another article titled “Detriment – Proprietary Estoppel’s Unwelcome Guest” (co-authored with Bennett Au-Yeung) has also been published by Trust Law International (Bloomsbury Professional). This article comments on Guest v Guest [2022] UKSC 27, a decision of the Supreme Court of the United Kingdom, in respect of the doctrine of proprietary estoppel and argues that the majority’s approach premised on expectation loss should be preferred.
