Prof. Michael RAMSDEN has published an article entitled “Strategic Litigation as a Catalyst for Global Dialogue: South Africa v Israel” in the University of Pennsylvania Journal of International Law.

This article argues that South Africa v. Israel at the International Court of Justice (ICJ) illustrates how ICJ proceedings extend beyond purely legal matters, serving as a tool for global public diplomacy. The case amplifies discourse and focuses attention on international crises through a legal lens. While direct on-the-ground impact is difficult to quantify, state reactions provide valuable empirical data. A comprehensive understanding of the ICJ’s impact requires moving beyond conventional dispute settlement models that focus solely on judicial remedies and compliance. South Africa v. Israel demonstrates how ICJ processes can trigger diplomatic initiatives, engage third states, and build pressure to modify the conduct of the allegedly responsible state and its allies. The dialogue generated by the case reveals a growing international consensus across Western and Global South states regarding the ICJ’s role in complex political situations. As strategic litigations before the Court increase, analysis must broaden beyond legal considerations to encompass the dialogue’s impact on the wider political landscape.
