Profs. Dicky TSANG and Jyh-An LEE’s work was cited in a WTO panel decision
Prof. Dicky TSANG and Prof. Jyh-An LEE’s co-authored paper “The Ping-Pong Olympics of Antisuit Injunction in FRAND Litigation” (2022) 28(2) Michigan Technology Law Review 305-383 was cited in the World Trade Organization (WTO) panel decision regarding Case DS 611, a significant trade dispute between China and the European Union (EU) in the past decade. In this case, the EU challenged China’s practices related to antisuit injunction (ASI) concerning standard-essential patents. These practices were alleged to violate the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement). The WTO panel cited Prof. Tsang and Prof. Lee’s paper in its report to support its stance on the legitimacy of courts issuing ASIs in accordance with domestic civil procedure law.
