To mark the twentieth anniversary of CUHK LAW and commemorate a decade since hosting the inaugural Directions in Legal Education conference, CUHK LAW is proud to present Directions in Legal Education 2026, to be held on 5-7 November 2026. This conference will bring together leading scholars, educators, practitioners, policymakers, and students to reflect on the evolution of legal education over the past decade, engage with the challenges and opportunities of the present, and explore future directions for teaching and learning in law.

Since its establishment, CUHK LAW has been committed to excellence in teaching and the holistic development of its students. The Faculty’s mission is to prepare graduates for leadership roles across the legal, commercial, public, and financial sectors while fostering a strong sense of professional responsibility and public service. In pursuing this mission, CUHK LAW has consistently championed innovation in legal education through conferences, seminars, workshops, and collaborative initiatives designed to enhance teaching practice and enrich student learning experiences.

In 2016, CUHK LAW hosted Hong Kong’s first conference dedicated to legal education, establishing an important platform for discussion, collaboration, and thought leadership in this emerging field. Ten years later, Directions in Legal Education 2026 builds upon that legacy by revisiting key developments, assessing current challenges, and considering how legal education must continue to evolve in response to technological change, globalisation, shifting professional demands, and the changing needs of students and society.

The conference aims to provide a dynamic and inclusive forum for open, informed, and forward-looking dialogue on the future of legal education in Hong Kong, Asia, and beyond. By bringing together diverse perspectives from academia, the legal profession, government, and the student community, the event seeks to generate new insights, share best practices, and inspire innovative approaches to teaching law in a rapidly changing world.

Through keynote addresses, panel discussions, interactive sessions, and opportunities for collaboration, Directions in Legal Education 2026 will celebrate past achievements while charting new directions for the next generation of legal education. Register Who owns a shipwreck? The flag state? The coastal state? A salvor? A museum? Or the communities whose histories, identities, and livelihoods are intertwined with the sea? Across Asia, underwater cultural heritage lies at the centre of competing claims involving governments, commercial salvors, museums, collectors, archaeologists, local communities, and the descendants of those connected to historic vessels. Legal frameworks are essential for resolving questions of jurisdiction and ownership, but they cannot by themselves determine how underwater cultural heritage should be valued, interpreted, or safeguarded. Many of the most significant challenges extend beyond law to questions of ethics, identity, memory, and social justice. Drawing on archaeological research and heritage projects from across Southeast Asia—including Cambodia, Indonesia, and the broader South China Sea—this lecture explores how shipwrecks have become contested places where historical narratives, economic interests, and cultural values intersect. Through case studies ranging from commercially salvaged cargoes and colonial-era shipwrecks to wartime wrecks and living maritime traditions, it examines how different stakeholders understand ownership, significance, and responsibility. Rather than asking who has the strongest legal claim, this lecture argues that ownership is the wrong question. The more important question is who has the responsibility to safeguard Asia's underwater cultural heritage, and for whose benefit. By placing communities, collaboration, and sustainable heritage management at the centre of decision-making, underwater archaeology can move beyond debates over treasure and title to become a means of protecting cultural identity, supporting local livelihoods, strengthening international cooperation, and ensuring that underwater cultural heritage continues to benefit present and future generations. About the Speaker: Sarah Ward is a Maritime Archaeologist and Doctoral Researcher based at the Centre for Heritage and Museum Studies at the Australian National University, where she explores critical, participatory approaches to the governance and safeguarding of maritime and underwater cultural heritage in Asia. Her work examines how archaeology can contribute to sustainable development by connecting communities, policy and practice through collaborative, action-oriented research. Recognised by UNESCO as "one of Asia-Pacific's most distinguished and experienced experts" in underwater cultural heritage, Sarah has more than 24 years of international experience spanning academia, government, consulting and the not-for-profit sector. She has led archaeological investigations, heritage management projects and capacity-building initiatives throughout the Asia-Pacific, with particular expertise in maritime archaeology, underwater cultural heritage, heritage governance, and community-based heritage management. Sarah is the founding Executive Director and Chair of the Council for Asian Underwater Cultural Heritage (CAUCH), Co-Director of the China–Cambodia Underwater Cultural Heritage Cooperation, and a Consultant Foreign Expert to China's National Centre for Archaeology. An MIT Ocean Discovery Fellow and Fellow of the Explorers' Club, she was Dalian Maritime University's first Professor of Underwater Archaeology and has also held visiting professorships at Ocean University of China and Shandong University, China. Her current work seeks to reframe underwater cultural heritage beyond questions of ownership, advancing collaborative approaches that safeguard maritime heritage while strengthening cultural identity, community resilience, and sustainable futures across Asia. Register Long before the unification of China, legal and administrative documents already discussed the difficulties involved in governing the stupid. This seminar explores various aspects of this multi-faceted problem, beginning with early attempts to define when stupidity had crossed into an intellectual impairment, which meant that the individual concerned could no longer be held legally responsible for their actions, but was also subject to discriminatory legislation. Issues also arose when individuals were demonstrably afflicted with senile dementia, as theorists debated whether this disqualified them from holding positions of power. Subsequently, I consider the problem of administering ordinary stupid men and women. Thinkers in early China commonly described stupidity as a manageable issue, but one which nevertheless required harsh punishments to act as a deterrent. While older stupid men and women were generally credited with sufficient sense to avoid getting themselves into legal trouble, there was apparently a never-ending supply of young stupid people with poor impulse control engaging in criminal acts. Legal theorists argued that severe penalties making an example of them, while unpleasant for everyone concerned, nevertheless demonstrated to their victims that justice was done. Finally, there is the problem of the stupid ruler, who was responsible for creating legislation in the first place. As the Legalist philosopher Han Feizi noted, few rulers are sages or irredeemably wicked, most are just run-of-the-mill stupid. However, the task of getting them to make good laws could be a considerable challenge for their ministers. About the speaker: Olivia Milburn, Professor at the School of Chinese, HKU. Her research focuses primarily on discourses of power and how this affects marginalized groups—such as members of ethnic or sexual minorities, the mentally or physically impaired, and those of low socio-economic status—in early and medieval China, including through discriminatory legislation. She has written extensively on gender-based and domestic violence in ancient China, and is currently at work on a new study of the writings of Han Feizi, as well as co-editing (with Albert Galvany) the first study in any language about stupidity in early China. Her books include The Spring and Autumn Annals of Master Yan (2016); The Empress in the Pepper Chamber: Zhao Feiyan in History and Fiction (2021); Kingdoms in Peril (2023); Spring and Autumn Annals of the Kingdoms of Wu and Yue: A Literary Translation of the First Chinese Novel, Wu Yue chunqiu (2024); and Khitan and Mongol Imperial Women in the Chinese Imagination: Ming Fantasies about Conquest Dynasty Harems (2025). Register
Sham and illusory trusts are, in their modern forms, relatively recent and controversial doctrines. Although the sham doctrine has an orthodox core, Taylor v Savik has reopened questions about whether the common-intention requirement applies universally and whether sham necessarily entails an intention to mislead or dishonesty. The nature and limits of the illusory trust doctrine have likewise been debated since Clayton, Pugachev, and Webb. This seminar examines the foundational and recent case law and asks how settlor direction and control—exercised through letters of wishes, reserved powers, formal roles within the trust structure, or informal commercial pressure—should influence the development of these doctrines.

About the Speaker:

Mark Bennett is an Associate Professor in the Faculty of Law at Te Herenga Waka, Victoria University of Wellington, New Zealand. He is a trusts law scholar whose work examines the boundaries of legitimate trust form, including settlor control, illusory trusts, asset protection, and the use of trusts to avoid or subvert other areas of law. He is a co-editor of the Oxford Handbook of Comparative Trust Laws, and has published articles in the Oxford Journal of Legal Studies, the King's Law Journal, the Osgoode Hall Law Journal, the Journal of Equity, and Law and Philosophy, among others. Mark holds an LLB (Hons) and BA from Victoria University of Wellington, an LLM from Harvard Law School as a Frank Knox Memorial Fellow, and a SJD from the University of Toronto, where he was a Connaught Fellow.

*CPD credits are available upon application and subject to accreditation by the Law Society of Hong Kong (currently pending).
In this seminar, Maxence Rivoire will present some of the main findings of his forthcoming book, The Principles of Territoriality in Intellectual Property Arbitration. Territoriality is often invoked as a self-evident, authoritative principle in support of solutions to jurisdictional and applicable law problems arising in intellectual property arbitration. Yet territoriality is not a unitary concept, but an umbrella term encompassing several distinct ideas. Drawing on a wide range of comparative sources and recently published arbitral awards, the book brings together insights from intellectual property law, international arbitration, and private international law to disentangle the different meanings of territoriality and examine their implications for intellectual property arbitration. In particular, the seminar will consider how these different understandings of territoriality affect the arbitrability of intellectual property disputes and the determination of the applicable law.

About the Speaker:

Dr Maxence Rivoire is a Lecturer in Law at the Dickson Poon School of Law, King’s College London. He is also an academic fellow of the Honourable Society of the Middle Temple, and an associate member of the Panthéon-Assas Institute of Comparative Law.

Maxence's research focuses on private international law, international arbitration, and intellectual property, with a strong emphasis on the comparative aspects of these disciplines. During first part, international investment law, its origins and content will be discussed. Second part will focus on contemporary challenges which IIL, and especially ISDS faces today. This will allow students to discuss what is the future of IIL/ISDS. About the Speaker: Dr Żenkiewicz is an academic and legal adviser on international law.
For almost a century the duty of care has attracted calls for reform, ranging from its elimination as a historical accident to its deconstruction of the various questions now gathered under duty, to breach, remoteness, causation, damage and the defences. Running against this, the courts have been charged with quietly moving in the opposite direction, over-specifying the duty question so that cases once resolved at other elements come to be resolved through the duty analysis instead. This paper argues that the more consequential “surreptitious” movement has in fact been the first. The principal case study is Deloitte & Touche v Hin Leong Trading, in which a five-judge Court of Appeal of Singapore declined to define the duty of care by reference to the particular damage claimed, on the ground that this would fold remoteness into duty, and removed the SAAMCo limitation from the scope of the duty altogether. That decision is read alongside recent English authority, including Darnley, Robinson, Poole, Paul and Tindall, and against the contrary pull of Manchester Building Society and Khan v Meadows, in order to ask three questions: what is actually being relocated; whether the relocation can be traced to arguments made in the literature or merely converges with them; and what turns on the move by way of pleading, proof and appellate control. The broader concern sought to be addressed is with the duty element in the common law of negligence and its relationship to the other elements of the tort.

About the Speaker:

Aaron Yoong is an Assistant Professor of Law at the Yong Pung How School of Law, Singapore Management University. He is the principal author of Commercial Injunctions in Singapore, and a contributor on the Law of Torts in Singapore. His work has been published in journals such as the Lloyd's Maritime and Commercial Law Quarterly, Tort Law Review, Torts Law Journal, and Arbitration International, and have been cited in judgments of the Singapore court. He is also actively involved in committee and law reform work with various governmental bodies, and external agencies such as the Singapore Academy of Law. Aaron maintains a broad commercial practice, focussing on cross-border disputes and international enforcement. As a foundational and transformative figure at CUHK LAW, Professor Rhodes revolutionalised legal advocacy by institutionalising mooting as a core educational pillar. Under his legendary guidance, teams achieved historic milestones, including the 2016 Vis East Moot championship, proving that rigorous training shapes world-class advocates. Moving from his legacy, this address analyses the changing tides driven by geopolitical dynamics, digital integration, and heightened demands for ethical transparency within modern international dispute resolution.

About the Speaker:

Anthony Neoh, SC, Chairman, Asian Academy of International Law.

Dr Anthony Neoh, SC, JP is a senior member of the Hong Kong Bar specialising in international litigation and arbitration.
In 2025 the International Law Commission (ILC) took up the topic "Compensation for the damage caused by internationally wrongful acts", and in 2026 it discussed the first report of its Special Rapporteur. One of the most complex questions the Commission will have to address is how compensation is to be determined when there is a concurrency of causes of harm. This may occur when states act together, as in joint armed attacks on a third state. It may also occur when independent acts add up to cumulative harm, as with climate change or marine pollution. Such situations raise two questions: how the causes of harm are to be established, and how the obligation to make reparation should be divided among multiple actors. The law of international responsibility, as codified by the ILC, offers few rules on which courts and states can rely to answer these questions, and the Commission will need to develop them in its work on compensation. In this talk, Professor Nollkaemper will examine which principles of international law can help fill this gap. He will draw on recent case law of the International Court of Justice, notably the 2022 compensation judgment in Armed Activities on the Territory of the Congo (DRC v. Uganda) and the 2025 advisory opinion on the obligations of states in respect of climate change, as well as relevant state practice.

About the Speaker:

Professor André Nollkaemper is Distinguished Professor International Law and Sustainability at the University of Amsterdam. He is a former Dean of the University of Amsterdam Law School, former president of the European Society for International Law, and former External Legal Advisor to the Minister for Foreign Affairs of the Netherlands.
In the modern sense, law often refers to a coherent system of rules, a distinct branch of knowledge, a specialized professional community, and an institutionalized mechanism for resolving disputes. However, this conception of law—centered on justiciability—is not universally applicable across all cultures and historical contexts. From the perspective of social governance and normativity, this seminar provides a case study of a so-called “lawless” traditional society such as imperial China that offers new insights into the conception of law.

The seminar explores the forms of normativity that regulate people’s lives and guide their actions in China from a historical perspective, while questioning conventional understandings of the distinctive features of the Chinese legal tradition. “Heavenly Principles, National Law, Human Sentiments”—tianli, guofa, renqing—may be seen as a characteristic representation of “law” in the Chinese mind, in which these are not understood as three separate normative orders. This conception differs from the Western distinction between law and morality. Reconsidering “law” in these terms invites us to reflect critically on the modern system of law, even of social sciences, and to trace the legacy of traditional normative ideas that remains deeply embedded in Chinese legal practice today.

The seminar also warns that this does not mean romanticizing the past. The challenge, therefore, is to escape Western categories without retreating into cultural relativism. By placing different historical conceptions of law into dialogue, legal history may contribute to a more universally applicable jurisprudence.

About the speaker:

WANG Zhiqiang, Professor of Fudan University Law School.
Each year, multilateral development institutions provide billions of US dollars in financing for projects around the world. Such extensive investment, often in infrastructure and natural resource sectors, means that whether development is sustainable depends not only on the scale of financing, but also on how effectively environmental and social (‘E&S’) risks are governed throughout project implementation. This talk examines how integrity sanctions systems already operating within multilateral development banks (“MDBs”) can strengthen E&S governance and advance sustainable outcomes in MDB-financed projects.

Using the World Bank Group’s Sanctions System as its principal case study, the talk explains how sustainable procurement reforms embed E&S requirements in bidder representations and contractual performance requirements. These requirements create jurisdictional touchpoints through which existing prohibitions on fraudulent, corrupt, collusive, coercive, and obstructive practices can be applied to E&S-linked misconduct by contractors and other third parties. The Sanctions System thereby complements the World Bank’s established E&S oversight mechanisms by enabling direct accountability for project implementers and providing additional investigative capacity, deterrence, and compliance-based rehabilitation.

The talk then broadens the analysis by examining additional ways in which integrity sanctions may contribute to sustainable outcomes in MDB development financing. It considers, for example, how financial remedies imposed through integrity sanctions regimes may be used to support remediation and other sustainability-related purposes. The talk will also offer preliminary reflections on the governance frameworks and other enabling conditions that may be relevant to the utilization of such measures by the MDBs.

About the Speaker:
Mr. Chang Liu is Counsel in the World Bank’s Office of Suspension and Debarment, where he participates in the review of sanctions cases to assess whether companies or individuals should be suspended or debarred from eligibility for World Bank–financed contracts. Before joining the World Bank, he practiced at leading international law firms, advising clients on white-collar defense, internal investigations, and complex cross-border commercial disputes. Outside his role at the World Bank, Mr. Liu serves as Diversity and Inclusion Officer for the International Bar Association’s Forum for Government and Public Lawyers.
This book examines how civilization modes determine constitutional effectiveness, comparing the Chinese moral duty-driven civilization with the Western desire-driven civilization.

The Chinese civilization is oriented by cosmic apprehensiveness, structured by the "mutuality of existence" ontology (I live because of others, I must live for others), and driven by (unconditional) moral duties. Moral duties 1) create "existentiality" (—a baby lives because his mother unconditionally fulfils her maternal duties); 2) generate the capacity to distinguish good from evil, right from wrong in human affairs, and 3) optimise and sustain the conversion mechanism of "duty generates order, order generates functions" —When citizens comply with legal rules under moral duties, they activate compatible orders producing sustainable constitutional functions—freedoms, rights, equality, governance, reform, etc.. A moral duty - sustained conversion mechanism is the hallmark "source code" for universal constitutions. The Chinese moral duties tradition has ensured her long periods of national and social development, harmony with her neighbours, and has catapulted an impoverished China back to fast-track development since the late twentieth century.

Western civilization, dominated by religious faith and, since five centuries ago, by liberated human desires, is fundamentally amoral. Human desires liberated in Europe are amoral, possessive, exclusive, and conflicting life forces. Liberated individual desires have since been normalized to produce a "desire-driven, liberal constitutional paradigm." It comprises amoral and incoherent “freedom, democracy, free market, social justice, etc.” These amoral and incoherent constitutional functions have fuelled centuries of imperialist wars, colonial expansions, two devastating world wars, and other conflicts. After the war, amoral desires were elevated to the "universal value" of “human rights”, causing Western powers to confuse, and justify "desire-driven post war hegemony" for "international justice," which provokes endless further wars. A civilisation that mistakes amoral desires for human rights is a sub-civilisation, and produces only sub-universal constitutional functions.

The book argues that liberals should transform Western amoral "imperialist nations" into "civilization nations" by seeking and activating their own moral duty traditions. Only by choosing a "life of duties" can one truly enters a "life of freedom."

About the Speaker:

The author is a Practising Barrister and Senior Counsel. In the 1980s, he joined the Hong Kong Department of Justice as a public prosecutor. Through his early-year attachment to Lincoln's Inn in London and involvements in criminal appeals at the Privy Council, he experienced both the strength and subtlety of the common law in its grandeur years.

His prosecutorial duties covered mainly commercial crime, corruption, criminal appeals, and related administrative law litigation.
At the turn of the 19th century, Thomas Bruce, 7th Earl of Elgin had the Parthenon marbles hacked out of the ancient temple in Ottoman-occupied Athens, removing half of its sculptural decoration and causing irreversible damage to the building's structure. In 1816, deep in debt, he sold the marbles to the British government, which subsequently entrusted them to the British Museum. Almost half a century later, in another country, his son, James Bruce, 8th Earl of Elgin, ordered the destruction of the Old Summer Palace in Beijing during the Second Opium War. This resulted in countless artefacts being dispersed across collections around the world. Today, the question is asked: what can be done to help this cultural heritage find its way home?

About the Speaker:

Catharine Titi, Dr iur., is an international lawyer and tenured Research Associate Professor at the French National Centre for Scientific Research (CNRS)–CERSA, Paris-Panthéon-Assas University, France. She has formerly served as Co-Chair of the Academic Forum on ISDS, whose work contributes to the discussions in Working Group III of the United Nations Commission on International Trade Law (UNCITRAL WG III) and on the Board of the European Society of International Law (ESIL).
