CUHK LAW Alumni Online Seminar – 'A Gentle Divorce: The Benefits of Collaborative Practice as an Out of Court Dispute Resolution Process in Family Law Matters’

This presentation outlines Collaborative Practice as a respectful, out-of-court dispute resolution process for family law matters, positioning it as an alternative to contentious litigation. Its core tenets include a “Participation Agreement” committing parties to avoid court and a team-based approach focused on future outcomes. The interdisciplinary team consists of lawyers and jointly appointed experts, notably a Financial Neutral to manage finances and a Mental Health Neutral. This mental health professional is integral to the process, guiding emotional dynamics, facilitating communication, developing co-parenting strategies, and representing the child’s voice, ultimately aiming for a less emotionally and financially costly settlement.

About the Speakers:

Patricia is a Solicitor and a Collaborative Practitioner. She is the Chairperson of the Hong Kong Collaborative Practice Group and she has been practicing matrimonial and family law for over 14 years. Patricia advises on all aspects of matrimonial law including divorce, separation, nuptial agreements, complex children and financial matters. Patricia values the importance of preserving family relationships during divorce and separation. She believes in collaboration and alternative ways of resolving disputes, with a focus on helping families resolve conflict constructively through communication and cooperation without resorting to litigation.

Winnie sees her role as a problem solver, helping clients resolve their family conflicts with bespoke solutions that draw from a variety of dispute resolution options. She seeks to improve the resolution of family conflict, include introducing and developing Collaborative Practice and Parenting Co-ordination as means of dispute resolution in Hong Kong. In addition, she is trained in family mediation, to act as a child consultant in child-inclusive mediation, and in private financial adjudication.  

Winnie is a founding member and was the ex-Chair of the HKCPG.  She has been on the executive committee since its inception.  

Joanne is a Collaborative Practitioner, Solicitor, Partner and Head of the Family Practice at Tanner De Witt. Joanne advises clients across all stages of family law, including cohabitation, paternity, adoption, prenuptial agreements, marriage, separation and divorce. As a HKMAAL qualified Family Mediator, Joanne frequently advises clients engaged in mediation as a means to resolving conflicts. In addition, Joanne is a Qualified Practitioner of the Hong Kong Collaborative Law Practice Group and a qualified Parenting Coordinator.

Joanne studied Law in England before being admitted as a solicitor in Hong Kong in 2008. She was awarded a Master of Laws (LLM) from The University of Hong Kong’s Faculty of Law in 2018. Joanne is on the firm’s Wellness Committee and sits as a Committee Member of the Hong Kong Family Law Association.

Dr. Zaidi is a registered Clinical Psychologist in the United Kingdom and Hong Kong. She has more than a decade of clinical experience with a wide variety of mental health, social emotional, behavioural and relationship challenges. She specialises in working with adults, families and couples. In her practice, Dr. Zaidi’s therapeutic style uses evidence-based treatment solutions empathetically and collaboratively with her clients to help them overcome personal barriers to growth. Recently Dr. Zaidi has been an essential driving force in raising awareness of Collaborative Practice in Hong Kong as a respectful and dignified option for separating / divorcing families through her role as a Mental Health Neutral and Executive Committee Member for HKCPG. 

Professor Yueming Yan, Assistant Professor & Assistant Dean (External Engagement), CUHK LAW

Dr. Chen YU is an Assistant Professor at the City University of Hong Kong, School of Law. Her research interests include international investment and trade law, international arbitration, interdisciplinary and empirical research of law, and energy regulation. She has published in leading international law journals including the Journal of International Economic Law, World Trade Review, Journal of International Dispute Settlement, ICSID Review, Journal of World Investment & Trade, etc. Her monograph, Dispute Settlement and the Reform of International Investment Law: Legalization Through Adjudication, was published by Edward Elgar in 2023. She was the recipient of the 2022 David D. Caron Prize awarded by the American Society of International Law (ASIL) and currently serves on the Advisory Board of ASIL’s International Law & Social Science Interest Group.

Prof. Yun ZHAO, LLB, LLM (China University of Political Science and Law), LLM (Leiden University, the Netherlands), PhD (Erasmus University Rotterdam). Prof. Zhao is Henry Cheng Professor in International Law and Associate Dean (Mainland Affairs), Faculty of Law, the University of Hong Kong (HKU).

Prof. Zhao is currently Representative of Regional Office for Asia and the Pacific (ROAP) of the Hague Conference on Private International Law (HCCH). He is appointed as Justice of the Peace, HKSAR. He is Standing Council Member of Chinese Society of International Law and Chinese Society of Private International Law; Council Member of Chinese Law Society. He is listed as arbitrator in several international arbitration commissions. He has published widely on various topics including particularly Space Law, Dispute Resolution.

Professor Normann Witzleb, Associate Professor, CUHK LAW

Abubakri Yekini is a law lecturer at the University of Manchester, focusing his research on the progressive development of conflict of laws in Africa. He is the author of the monograph titled “The Hague Judgments Convention and Commonwealth Model Law: A Pragmatic Perspective” (Hart Publishing, 2021).

Yekini served as a visiting scholar at the Max Planck Institute Luxembourg for International, European, and Regulatory Procedural Law in 2019 and later as a Schumann Fellow at the University of Munster, Germany in 2022. He is a founding member of the Nigeria Group on Private International Law (NGPIL) and serves as an assistant editor for both the Ethiopian Yearbook of International Law and the Lagos State University Law Journal.
