CLINDS’s 16th Intellectual Property Law Book Talk – ‘FRAND Cases in Context’ (Online)

The new volume FRAND Cases in Context (Edward Elgar, 2026) analyses the leading legal cases pertaining to the licensing of standards-essential patents (SEPs) on fair, reasonable and nondiscriminatory (FRAND) terms around the world. It includes detailed discussions of 28 of the most influential FRAND cases decided in the United States, Europe, Asia, South America and the WTO covering topics such as injunctive relief, monetary damages, antitrust and competition and anti-suit (and anti-anti-suit) measures. It is anticipated that this work will serve as a valuable resource for judges, advocates and policy makers for years to come. At this virtual event, several of the distinguished authors will provide background and commentary on the work and their individual contributions.

About the Speakers:

Enrico Bonadio is Professor of Law at City St George’s University of London, where he teaches, researches and advises across the full spectrum of intellectual property law, with a particular interest in how IP responds to technological changes and to non conventional creative practices such as street art, music borrowing and gastronomy. His work combines doctrinal analysis, empirical inquiry and sustained engagement with creative communities, policymakers and international organisations.

Jorge Contreras is a University Distinguished Professor, the James T. Jensen Endowed Professor for Transactional Law and Director of the Program on Intellectual Property and Technology Law University of Utah S.J. Quinney College of Law in Salt Lake City, Utah, USA. He has published more than 150 academic articles and has written or edited 14 books on intellectual property, antitrust law and standardization, and has testified before committees of the U.S. Senate and House of Representatives, the Federal Trade Commission and the European Commission. He received his JD from Harvard Law School, earned his BSEE and BA at Rice University.

Yuan Hao is Co-Director and Senior Fellow of the Berkeley Asia IP and Competition Law Center (BAIC) and a Lecturer at UC Berkeley School of Law. Her research focuses on two intersecting themes: (1) IP’s role in facilitating human creativity in an AI-powered age, and (2) IP’s role in facilitating private ordering and innovation ecosystems under authoritarian governance.

Rafał Sikorski, PhD (Adam Mickiewicz University), LLM (Central European University), is a professor of law at the Adam Mickiewicz University in Poznań (Poland). His major research areas include patent remedies, the nexus between IP and competition law, standard essential patents, as well as various forms of private ordering in IP and particularly patent law. He has published on patent pools, access to standard essential patents, patent remedies, conflicts-of-law rules for IP contracts and IP infringement as well as copyright law. Results of his research appeared in books published by, for example, Edward Elgar, Cambridge University Press, Wolters Kluwer and C. H. Beck. At the Law Faculty of Adam Mickiewicz University, he teaches various courses on IP, civil law, private international law and European Union law. Rafal Sikorski is also an attorney-at-law at one of the leading Polish law firms where he advises clients in matters related to licensing and protection of IP.

Discussant:

Haifeng Huang is regularly called on to lead teams and advise clients on their complex disputes and intellectual property matters. He has a broad practice covering disputes and transactions involving patents, trademarks, copyrights, trade secrets, unfair competition, antitrust, and technology licenses. The WTR 1000 described him as “one of the country’s most seasoned litigators, with a history of representing large U.S. and Chinese concerns in high-stakes disputes.” Haifeng has advised clients on cases in many courts and agencies throughout China and elsewhere, as well as before multiple arbitration tribunals. These cases have involved a diverse range of industries, including software and systems, semiconductors, microelectronics, telecommunications, textiles, chemicals, optics, consumer products, heavy machinery, pharmaceuticals, medical devices, and biotechnology. He also manages due diligence and transactions and negotiates agreements involving the acquisition, license, and commercialization of intellectual property assets, including R&D collaboration, sponsored research, joint development, clinical trials, cross-licensing, strategic alliance, manufacturing, distribution, consulting, and software services. Haifeng’s extensive experience has received significant recognition, including being named a “WIPR Leader” by World IP Review and selected as an “IP Star” by Managing Intellectual Property. He was also endorsed by peers and clients as a “strategic, very reliable and trustworthy” name and having a “top-notch IP practice” in China in Chambers Global (2020-2021).
